Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Digital Param LLC (“Digital Param”, “we”, “us”) for the use of digitalparam.com and our products Botly, Perkly and Spinly (the “Services”). By creating an account or using the Services, you agree to these Terms.

Accounts

You must give accurate information when you sign up and keep your login details secure. You are responsible for all activity under your account. If you use the Services on behalf of a company, you confirm you are allowed to accept these Terms for it.

Acceptable use

You agree not to use the Services to:

• break any law or infringe anyone’s rights;
• send spam or misleading, harmful or illegal content;
• attempt to access other accounts, disrupt the Services or reverse engineer them;
• resell the Services except through an official reseller or white-label plan.

Plans and payments

Plans are sold as one-time payments (OTP) or as subscriptions, as shown at the time of purchase. Each plan includes the limits listed on its pricing page. Subscriptions renew automatically until you cancel; after cancelling, access continues until the end of the paid period. Prices for new purchases may change at any time.

Lifetime deals

Lifetime plans bought through a marketplace give access to the plan’s features for the life of the product, subject to these Terms and the plan limits shown at purchase. On lifetime plans, AI features may require you to connect your own AI provider API key, and you are responsible for that provider’s charges.

Third-party services

The Services connect to third-party platforms such as WordPress, WooCommerce and AI providers. Your use of those services is governed by their own terms, and we are not responsible for their availability or changes.

Your content

You keep ownership of the content and data you add. You give us permission to host and process it only as needed to provide the Services. You are responsible for having the right to use that content and for your customers’ data.

Our intellectual property

The Services, including the software, design, logos and trademarks, belong to Digital Param LLC. These Terms do not give you any rights to them except the right to use the Services as described here.

Refunds

Refunds are covered by our Refund Policy.

Suspension and termination

We may suspend or close accounts that break these Terms or put the Services or other users at risk. You can close your account at any time. After closure, we may delete your data after a reasonable period.

Disclaimers

The Services are provided “as is” and “as available”. AI-generated replies can be inaccurate, and you are responsible for how you use them. We do not guarantee that the Services will be uninterrupted or error-free, or any specific business result.

Limitation of liability

To the extent allowed by law, Digital Param will not be liable for indirect, incidental or consequential damages, or for lost profits or data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

Governing law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules.

Changes

We may update these Terms. If a change is significant, we will notify you by email or in the Services before it takes effect.
